Building Permits
Construction projects typically require a building permit, which can only be obtained by the property owner or the owner's licensed and Bonded contractor.
Construction may begin only after the permit has been issued and must start within 180 days. Additionally, construction must not halt entirely for more than 180 days. If either of these timeframes is exceeded, the permit will automatically expire, necessitating a new application for a building permit. If you require an extension, please call 432-685-7390.
Note: Permit applications and other payments will not be accepted or issued after 4 PM. Accepted payment methods include cash, checks, money orders, and credit/debit cards.
Permitting Process
- Project Submission: Submit the permit application and related documents, and pay the 25% fee via the web link provided here or in person.
- Under Review: A plan reviewer examines the submitted plans and documents. This usually takes about 5 to 7 business days. The timeline varies for commercial projects depending on the type of work:
- New commercial and additions: 20 business days
- Commercial alteration and repair, accessory structures, and commercial swimming pools: 7 to 10 business days
- Verification: The plan reviewer will notify you of approval via email. You must pay the remaining 75% of the application fee at this time. A bonded contractor must be listed on the permit for issuance.
- Permit Issued: Once the payment is collected, a permit number is issued to you. The permit must be visible on the job site.
- Inspections: An inspector reviews the construction at various stages of the project to ensure compliance with various codes and state and federal guidelines.
- Certificate of Occupancy: Upon final inspection of the completed project, a certificate of occupancy is issued to the project owner. At this point, the building or structure can be used or occupied by the public. This applies to changes in occupancy, additions to existing occupancies, and new construction projects.

Include the project address in the subject line of your email. Instructions for payment will be emailed to applicants.

The property you are proposing to build upon must be platted and zoned for residential use. You must verify that the zoning of your land allows for residential use. For more information, please contact the Planning Department .

Commercial Permitting
A commercial permit is required for all work performed on commercial structures. To obtain a permit, you must be a licensed and bonded contractor registered with the City of Midland.
Note: Check the jurisdiction and zoning to determine if your property is located within the Extraterritorial Jurisdiction (ETJ) or city limits.
